- The Merlin Benefit is open to all Eligible Members who comply with these terms and conditions. You must be a Vitality Plus member to qualify for this benefit and must meet all qualifying criteria below.
- For the purpose of these terms and conditions the following definitions apply;
a. Active means that a Vitality plan has no unpaid premiums, has not lapsed and has not been cancelled by the Eligible Member or by Vitality;
b. Active Week(s) means the calendar week, commencing at 12:00am Monday and ending on 11:59pm Sunday, during which an Eligible Member earns 12 Activity Points, or a lower threshold as determined by Vitality if applicable. Only Activity Points earned during that period count towards the weekly goal for the purpose of unlocking a 4-Week Streak. Further information about unlocking a 4-Week Streak can be found here;
c. Activity Points means activity-based points that have been awarded to an Eligible Member through the Vitality Programme for participating in physical activity as recognised by Vitality;
d. Attraction Accommodation(s) means (but is not limited to) the following; The Alton Towers Hotel, CBeebies Land Hotel, Splash Landings Hotel, Enchanted Village (Woodland Lodges and Luxury Treehouses) and Stargazing Pods at the Alton Towers Resort, Safari Hotel, Azteca Hotel and Explorer Glamping at Chessington World of Adventures Resort, Tower Suites and Knight’s Village at Warwick Castle, Thorpe Shark Cabins at Thorpe Park Resort or the LEGOLAND® Resort Hotel and The LEGOLAND® Castle Hotel at the LEGOLAND® Windsor Resort;
e. Eligible Member(s) means anyone 18 years old and over with an Active Vitality Plan who:
i. are residents of the United Kingdom or British Crown Dependencies;
ii. are registered on the Member Zone;
iii. have completed their Health Profile; and
iv. achieve a 4-Week Streak
A reference to ‘you’ in these terms and conditions means an Eligible Member;
f. 4-Week Streak means the achievement by Eligible Members who have maintained 4 Active Weeks in a row, after which those Eligible Members may, via the Vitality UK App, select and unlock two Rewards in accordance with these terms and conditions. Further information about the 4-Week Streak feature can be found here:
g. Health Profile means the feature within the Vitality UK App which shows Vitality members a clear picture of their current health with tips on how to improve it, following Vitality members completing an online health questionnaire in their current Plan Year;
h. Member Zone means the online portal available to members of Vitality (via personalised login) which allows them to review their Vitality Plan terms and other information relevant to their Vitality Plan;
i. Merlin means MERLIN Entertainments limited, (08700412) of Arbor Building, 16th Floor, 255 Blackfriars Road, London, SE1 9AX;
j. Merlin Benefit means the availability of a Voucher (and/or Uplifted Voucher subject to clause 8) as a Reward for Eligible Members;
k. Participating Attractions means Alton Towers Resort, Chessington World of Adventures Resort, Thorpe Park, The LEGOLAND® Windsor Resort, Warwick Castle, Shrek’s Adventure! London, Madame Tussauds (London or Blackpool), The Dungeons (London, York, Edinburgh or Blackpool Tower), The Blackpool Tower Eye, The Blackpool Tower Eye Circus, The Lastminute.com London Eye, LEGOLAND® Discovery Centres (Manchester or Birmingham), SEA LIFE Aquariums & Centres (Birmingham, Great Yarmouth, Loch Lomond, Blackpool, London, Brighton, Manchester, Scarborough, Hunstanton and Weymouth SEA LIFE Adventure Park), Cadbury World, The Gruffalo & Friends Clubhouse and Peter Rabbit Explore & Play Blackpool;
l. Plan Year means normally, the initial twelve-month period beginning on the start date of a member’s Vitality Plan and ending on the first anniversary of that start date and each subsequent twelve-month period thereafter. Where there is a change in plan holder or in some other circumstances, the start and end of the Plan Year may change despite a person remaining covered under a Vitality Plan at all times, giving a period of greater or less than twelve months accordingly. However, a Plan Year will always commence from the commencement date as shown on any plan documentation of a plan which a person is covered under;
m. Promotional Ticket(s) means a standard online full priced advance entry day ticket(s) available for use at Participating Attractions purchased using a Voucher or an Uplifted Voucher;
n. Rewards means the Vitality partner rewards available for selection by Eligible Members who have unlocked a 4-Week Streak including, but not limited to, the Voucher as part of the Vitality Programme;
o. Secondary Attractions means the following attractions and events including, but not limited to; Zoo Days or Winters Tail Event at Chessington World of Adventures Resort, The Alton Towers Dungeon, Extraordinary Golf, Treetop Quest, the Waterpark and the Scarefest Halloween Event Mazes at Alton Towers Resort, Fright Nights Mazes at Thorpe Park Resort, The Castle Dungeon and Dragon Slayer at Warwick Castle, Junior Brick Week or Christmas events at LEGOLAND® Windsor Resort, LATES at The Dungeons and SEA LIFE London Aquarium, The Blackpool Tower Ballroom, Bar 380, The Fifth Floor or Dino Golf at The Blackpool Tower Eye;
p. Uplifted Voucher means the discount voucher which may be made available for selection by certain members from time to time as set out in clause 8;
q. Vitality means Vitality Corporate Services Limited (registered number 05933141) of 3 More London Riverside, London, SE1 2AQ trading as VitalityHealth and VitalityLife. A reference to ‘we’ in these terms and conditions also means Vitality;
r. VitalityHealth Plan means a private medical insurance plan or healthcare trust administered and arranged by Vitality. This includes the following plans only;
1. a personal healthcare plan ;
2. a business healthcare plan
3. a corporate healthcare plan with Vitality Plus;
4.a corporate healthcare trust with Vitality Plus;
but excluding ‘Vitality at Work’, ‘Vitality Essentials’ and ‘Vitality Health Lite’ products.
or
s. VitalityLife Plan means a non-investment long term insurance contract or trust scheme administered and arranged by Vitality with Vitality Plus;
t. Vitality Plan means a VitalityLife Plan and/or a VitalityHealth Plan;
u. Vitality Plus means the benefit called “Vitality Plus” which is included on certain personal and business VitalityHealth Plans and can be added to corporate VitalityHealth Plans and VitalityLife Plans for an additional fee;
v. Vitality Programme means the benefits programme administered by Vitality pursuant to which members are offered a range of wellness and lifestyle related Rewards;
w. Vitality UK App means the Vitality member app which is available on the ‘App Store’ for Apple devices or ‘Google Play’ for Android devices and allows Vitality members to manage their Vitality Plan and engage with the Vitality Programme;
x. Voucher means a discount in the form of a code offering 30% off the price of up to 4 individual Promotional Tickets in a single transaction;
y. Voucher Wallet means the e-wallet within the Vitality UK App where an Eligible Member can store their vouchers and Rewards once selected;
Selecting and using your Voucher
Provided that an Eligible Member has achieved a 4-Week Streak, Eligible Members will be eligible to select up to two Rewards, one of which may include the Voucher
3. We will unlock your Rewards;
a.
on a Monday immediately following a 4-Week Streak; or
b .
if all Activity Points have not been awarded by the end of a week, as soon as 12 Activity Points have been awarded to you for the preceding week (meaning you have achieved an Active Week for the preceding week)
4. If you select the Voucher, it will be saved and accessible within your Voucher Wallet.
5. The Voucher will be available for selection and redemption for four weeks. This four-week period will start from the immediate Monday after you have achieved a 4-Week Streak (and are therefore eligible to select your Reward(s) until 11:59pm on the Sunday of the fourth week regardless of the actual day on which you select the Reward(s). Therefore, you must both select and use your chosen Rewards within this same four-week period.
6. With respect to clause 6 above, if for example you select the Voucher at 11:58pm on the Sunday of the fourth week, the Voucher will still expire and be unavailable for use after 11:59pm on that same Sunday. If the Voucher is not selected within this period, you will not be able to select it again until you achieve another 4-Week Streak.
7. From time to time, Vitality may make available a separate discount voucher available for selection. This separate voucher will be available for selection for the following members: (1) members covered under a VitalityLife Plan; (2) a corporate healthcare plan with Vitality Plus; or a corporate trust scheme with Vitality Plus. This voucher will be for 50% off the price of up to 4 individual Promotional Tickets in a single transaction. Such members will not be able to select this voucher offering in addition to the other Merlin Voucher in the same calendar month. This voucher will count as one of the member’s Rewards for that calendar month and must be used within 30 days from the date is selected as a Reward. Once selected, it will be uploaded to the member’s Voucher Wallet and will be available for use. This additional benefit is called the “Uplifted Voucher
8. To purchase the Promotional Ticket(s), members who hold a Voucher or Uplifted Voucher must:
a. pre-book online only via: https://merlinmagic.biz/vitality/ ; and
b. purchase a Promotional Ticket no later than 11:00pm the night before the date of visiting a Participating Attraction.
9. The Promotional Tickets are subject to the following conditions:
a.
Promotional Tickets are limited in number and subject to availability of each Participating Attraction;
b.
Promotional Tickets are subject to the minimum number allocated every day that each Participating Attraction opens;
c.
Promotional Tickets pricing is based on Merlin’s dynamic pricing meaning that prices are influenced by factors such as seasonality and the estimated demand at the time of booking. Therefore, Promotional Ticket prices may vary;
d.
Promotional Tickets are subject to Merlin’s own terms and conditions.
e.
Promotional Tickets are not transferrable, non-exchangeable, and may not be redeemed for cash or re-sold;
f.
Promotional Tickets are for members’ personal usage and may not be (or attempted to be) re-sold or re-gifted to any other individual.
10. The Vouchers and the Uplifted Vouchers are subject to the following conditions:
a. Only one Voucher or Uplifted Voucher can be used per person, per transaction.
b. Vouchers or Uplifted Vouchers may not be used towards Secondary Attractions, Attraction Accommodations or tickets to any events held by Participating Attractions.
c. Subject to clause 22, Vouchers or Uplifted Vouchers are non-exchangeable, non-transferable and may not be redeemed for cash.
d. Vouchers or Uplifted Vouchers may not be used in conjunction with any other promotion, offer, discount, membership or reward/loyalty scheme.
e. Vouchers or Uplifted Vouchers may only be used via the unique link provided above at clause 9 and may not be used to book tickets directly with a Participating Attraction.
f. Vouchers or Uplifted Vouchers may not be used to obtain entry via any other means other than by purchasing Promotional Tickets This means that the Voucher may not be redeemed in combination with or towards the following non-exhaustive list:
i. pre-existing ticket bookings;
ii. group bookings;
iii. concession rate tickets for certain categories of people including but not limited to; senior citizens, veterans, family tickets, students, gift cards, or annual, monthly or seasonal pass holders;
iv. fast track, priority, early ride time or anytime tickets
v. stayover, 2-day stay, short breaks, or ‘spectacular stays’ tickets
vi. multi-attraction tickets including but not limited to; ‘Merlin’s magical London 5 in 1 pass’, or other combination attraction tickets;
vii. or any other tickets not available via the unique link at clause 9.
11. Eligible Members are encouraged to check all opening dates and times on each Participating Attraction’s individual website before their intended visit.
12. Vouchers, Uplifted Vouchers and Promotional Tickets can only be used as stipulated in these terms and conditions.
General
13. Vitality is not responsible for any actions, representations, omissions or defaults by Merlin in relation to the Promotional Tickets.
14. Any Vouchers, Uplifted Vouchers or Promotional Tickets which are attempted to be transferred for value, offered for sale or are sold will be automatically void.
15. The Vouchers, Uplifted Vouchers and Promotional Tickets remain the property of Merlin at all times and as such Merlin reserves the right to take possession or revoke the Vouchers, Uplifted Vouchers, and/or Promotional Ticket at any time.
16. Participating Attractions may, in their absolute discretion in certain circumstances, refuse entry to members and /or close and/or alter all or any part or feature of the facilities including closure of rides and/or attractions and removal of figures of figures for technical, operational, health and safety or other reasons including overcapacity.
17. Vitality reserves the right to amend these terms and conditions (including extending or withdrawing the benefits made available hereunder) on the provision of written notice or via Vitality’s website (vitality.co.uk).
18. Vitality is not responsible in the event that any member is unable to earn Activity Points, or is otherwise unable to take up any feature of the benefits under these terms and conditions, for any reason that is outside of Vitality’s control.
19. Vitality will not be liable for any lost Vouchers, Uplifted Vouchers or Promotional Tickets, including but not limited to, where a member has changed their contact details and failed to notify Vitality of this change, any technical fault, malfunction, hardware or software failure or network or server failure of any kind.
20. Any decisions made by Vitality over eligibility or otherwise in relation to the benefits in these terms and conditions are final and will not be open to dispute. Such decisions are made at Vitality’s sole discretion and no correspondence will be entered into.
21. Vitality reserves the right to substitute the Merlin Benefit with another benefit of a similar value.
22. Vitality reserves the right to refuse to award Vouchers or Uplifted Vouchers to anyone in breach of these terms and conditions.
23. All personal data of members will be held and used by Vitality for the purpose of promoting this Merlin Benefit in accordance with Vitality’s privacy notice (which can be found on https://www.vitality.co.uk/privacy/) and data protection legislation.
24. Vitality is the party legally responsible for the benefits described in these terms and conditions as the promoter.
25. Where there is any inconsistency between these terms and conditions and the terms and conditions covering the 4-Week Streak function, the 4-Week Streak terms and conditions shall prevail.
26. These terms and conditions are governed by English law and by taking part in the benefits described under these terms and conditions. All members submit to the exclusive jurisdiction of English and Welsh courts and tribunals with regard to any dispute or claim arising under these terms and conditions.
